Photographers always retain copyright of the photographs they take. To allow maximum flexibility, it is recommended that all rights or even exclusive rights are negotiated. This allows the images to be used for current projects and any future projects, including Web sites, without having to purchase additional rights. A
sample letter of agreement is available.
Sometimes it may not be possible to secure all rights. In the event that you choose to hire the photographer regardless, please be aware that most standard photography agreements allow the hiring organization to purchase rights for one-time print usage; any additional uses must be purchased from the photographer. (The rights to re-use photographs from past years, for example, would have to be re-negotiated and secured.) Also, please note that photos purchased for use in print publications are NOT covered for use on the Web under these contracts.

Photo Releases
DePaul also recommends having subjects sign a
photo release form before they are photographed for a project. This release gives DePaul permission to use the photo and comments in any university communication vehicle or any outside medium used to represent DePaul. It acknowledges that the signatory understands that the information may be published and shown in public, and that there will be no compensation provided for its use.
The law requires that subjects under 18 years of age have their parent or guardian sign their release. Sample of the
release form for minors is available.
